Referral Program Terms

These Referral Program Terms (“Program Terms”) apply to your participation in the Boll & Branch LLC (“Boll & Branch”) Referral Program, as defined below and described in more detail herein. Your participation in the Referral Program constitutes your agreement to these Program Terms. Boll & Branch may modify or cancel the Referral Program and these Program Terms at any time. The Referral Program is subject to and governed by Boll & Branch’s Privacy Notice and Terms of Service.

These Program Terms are not intended to modify other Boll & Branch agreement or terms that may govern the relationship between you and Boll & Branch. To see how Boll & Branch collects and uses your personal information, please see our Privacy Notice.

1. Referral Program. Subject to these Program Terms, Boll & Branch may offer you the ability to earn Discounts (defined below) when you invite friends to purchase from www.bollandbranch.com (the “Website”) (collectively, the “Referral Program”).
2. Referral Program Policy. You may invite friends, family members, or colleagues whom you know personally (“Friend(s)”) to purchase from the Website. To be eligible to earn Discounts, Friends may not be from your household, use the same IP address as you or have an existing account under an alternate email address. You will earn Discounts for Friends who are not existing customers of Boll & Branch and who are first-time customers as a result of your Authorized Invitation (as defined below). To earn Discounts, your Friends must make a qualifying purchase in an amount greater than the minimum amount specified on the Website or in our promotion messaging (“Minimum Purchase Amount”) prior to the offer expiration. There may be limits to how many Discounts you may earn from a Friend’s purchase. While there is currently no maximum number of Friends you may refer through the Referral Program, we reserve the right to set a limit for certain partners in our sole discretion as notified in writing.
   1. You must invite your Friends through one of the invitation mechanisms that we authorize through our Website or on our social media platforms (each, an “Authorized Invitation”). You will not earn Discounts based on invitations that are not Authorized Invitations. Authorized Invitations will expire within thirty (30) days of the date on which you generated them.
   2. You will only receive Discounts for each of your Friends’ first qualifying purchase (as described in the Authorized Invitation or elsewhere on the Website) made as a result of your Authorized Invitation within thirty (30) days from the date that you sent the Authorized Invitation. If your Friend does not follow the directions in the Authorized Invitation and/or does not make a purchase with the required time period, you may not receive Discounts.
   3. If a Friend returns a purchased item that results in their order falling below the Minimum Purchase Amount, your Discounts earned for that referral will be rescinded.
   4. Boll & Branch will email you your Discount within approximately 24 hours after one of your Friends makes their qualifying purchase and we ship their purchased Products. Discounts may only be used on the Website and may not be used on any other website.
3. Referral Program Restrictions and Limitations. You may not refer yourself or create multiple, fictitious or fake email addresses or accounts with Boll & Branch or any social media service that we determine in our sole discretion violates the spirit and intent of our Referral Program. You may not: (i) tamper with the Referral Program, (ii) act in an unfair or disruptive manner, or (iii) use any system, bot or other device or artifice to participate or receive any benefit in the Referral Program. You may not post on public websites “recipes” designed to instruct the general public how to commit fraud, increase your Discounts, or circumvent the spirit and intent of the Referral Program. You may not conduct your own promotion in connection with our Referral Program. You may not engage in any promotional, marketing, or other advertising activities on behalf of Boll & Branch or any other third parties, including by using any trademarks of Boll & Branch or other third parties unless otherwise authorized by Boll & Branch at its sole discretion. You may not use the Referral Program to violate any law, infringe, or violate the rights of any third party, or otherwise act in a manner that is deemed harassing, harmful, illegal, hateful, obscene, or outside the spirit and intent of the Referral Program.
4. Discount Terms. Any Discount is subject to Section 16.7 of the Terms of Service. Notwithstanding the foregoing, all Discounts issued under these Program Terms will expire thirty (30) days after issuance to you or Friend, as applicable. In addition to the limitations set forth in Section 16.7 of the Terms of Service, Discounts may not be used on Reserve, Supima, sale collection, gift cards, or any other products that are excluded from discounts.
5. Fraud; Reservation of Rights. We reserve the right to void referrals and Discounts if we suspect that the referrals or Discounts were earned in a fraudulent manner, in a manner that violates these Referral Program Terms or the Boll & Branch Terms of Service, or in a manner otherwise not intended by Boll & Branch. If we believe that a referral associated with you was used in such a manner, we have the right to remove all Discounts associated with you and remove you from the Website.
6. Void Where Prohibited. The Referral Program is void where prohibited by law. Boll & Branch reserves the right to modify or terminate the Referral Program at any time. Should there be any tax liability for the accumulation and/or use of Discounts, such taxes are your sole responsibility. You understand that your account on the Website may not accurately reflect the Discounts you have actually earned. Boll & Branch will have no liability for any errors displayed in your account with respect to Discounts.
